Privacy Statement

KLCK respects the privacy of anyone whose personal data is processed by KLCK, including visitors to the website www.klck.nl (hereinafter: “the website”). KLCK attaches great importance to the careful handling of personal data. KLCK will process your personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

KLCK processes personal data in accordance with the following four lawful bases:

1. In order to execute an agreement between you and KLCK, or your request to enter into such an agreement.

This basis applies when you make use of the services of KLCK or when you have requested a quote for these services.

In the context of this lawful basis for the processing of your personal data, KLCK will only process your personal data if and insofar as this is necessary for the fulfilment of the contractual obligations entered into with you. In this connection, your personal data may also be shared with third parties insofar as this is necessary for the execution of the agreement in question, such as with third-party service providers with whom KLCK collaborates in the performance of the agreed services.

If you have previously entered into an agreement with KLCK, KLCK may send you email messages, such as newsletters about its services, without prior consent, provided that these messages are reasonably relevant to you in view of your apparent interests based on (an) earlier agreement(s) with KLCK. You may opt out of receiving such communications in the manner indicated in the email messages in question.

2. A legitimate interest of KLCK.

This basis exists in the following cases:

  1. when KLCK automatically provides your personal data to the hosting party engaged by KLCK to enable the functioning of the website. This is necessary to store the personal data processed through the website and to ensure that the website and email services of KLCK work properly;
  2. when KLCK provides your personal data to an administrative office that takes care of the administration and bookkeeping for KLCK;
  3. the use of software to process and store the administration and accounts of KLCK;
  4. the use of chat software to enable the use of the relevant messaging tool;
  5. the use of Google’s cloud services.

The providers of the software or cloud services referred to under c), d) and e) store relevant personal data in order to be able to provide KLCK with the functionality of the software or cloud services.

In the context of ‘legitimate interests’, KLCK processes your personal data only if and insofar as this is necessary to fulfil the relevant legitimate interests.

3. Your consent.

This basis exists when:

  1. you contact KLCK by telephone, e-mail, through the contact form on the website or in any other way, or when you subscribe to newsletters. After all, you give your consent implicitly when you contact KLCK or subscribe to its newsletters;
  2. you have given permission, for example through a quitclaim, to use visual material in which you are depicted for specific purposes; 
  3. KLCK wants to use your personal data for other purposes or provide them to third parties. As such, your consent applies to specific processing and a specific purpose. If KLCK processes personal data for several purposes, KLCK will inform you of this and request your consent for each purpose separately.

In this context, KLCK will only process your personal data if and insofar as this is necessary to handle your request, or to carry out the activities for which you have given your consent.

If you have subscribed to newsletters, you may opt out of receiving them in the manner indicated in the emails in question. 

4. A legal obligation.

This basis exists when KLCK must comply with a legal obligation, such as the retention of invoices and payroll records for seven years, as required by law.

Access to personal data 

Only authorised employees of KLCK have access to your personal data and only to the extent necessary to perform their tasks. This also applies to third parties as referred to above with whom KLCK shares personal data. KLCK will under no circumstances sell your personal data. The persons who fall under the responsibility of KLCK, as well as any third parties engaged by KLCK, are obliged to respect the confidentiality of your personal data. To the extent that KLCK outsources the processing of personal data to a third party, KLCK will take the necessary steps to ensure that your personal data is adequately protected. If and to the extent required by law, such steps include: entering into a data processing agreement with such receivers to ensure that they take the same or similar technical and organisational measures as KLCK, to ensure that your personal data is adequately protected.

Cookies used by KLCK

KLCK uses functional and analytical cookies on its website. A cookie is a small text file that is stored in the browser of your device when you visit the website. Cookies with only technical functionality (functional cookies) ensure that the website works properly and that, for example, your preferences are remembered. These cookies are also used to keep the website working properly and to optimise it.

KLCK uses analytical cookies to collect data for analysis purposes in order to gain a better understanding of the use of the website by its visitors. To this end, KLCK uses Google Analytics to help analyse how the website is used by collecting log data and visitor behaviour on the website in anonymised form. The visitors’ IP address is masked, a data processing agreement has been entered into with Google, and no data is transmitted for any additional Google services.

You can prevent or restrict the use of cookies by selecting the relevant settings in your Internet browser. However, if you restrict the use of cookies, it is possible that the functionalities of the website cannot be used to their full extent.

Your rights

You have the right to access your personal data and you have the right to request KLCK erasure or rectification of it, as well as to restrict the processing that concerns you. You also have the right to object to the processing and you have the right to portability. This means that you can submit a request to KLCK to send the personal data that KLCK processes, in a computer file to you or an organisation specified by you.

To ensure that the request is made by you, KLCK requires that you include a copy of your proof of identity with the request. Please block out the MRZ (machine readable zone, the strip with numbers on the document), document number and Citizen Service Number (BSN) in this copy. This is to protect your privacy. KLCK will respond to your request as quickly as possible, but at least within four weeks. 

To the extent that the processing of personal data is based on consent that you have given, you have the right to withdraw such consent at any time, but this does not alter the lawfulness of the processing on the basis of the consent before the withdrawal.

You have the right to lodge a complaint with the Dutch Data Protection Authority or, if you live or are registered in a country other than the Netherlands, with the supervisory authority there.

Retention of personal data

Personal data is retained by KLCK only for as long as is necessary for the purposes for which it was obtained. KLCK uses suitable technical and organizational measures to secure personal data against loss and against any form of unlawful processing. These measures guarantee, taking into account the state of the art and the costs of implementation, an appropriate security level with regard to the risks involved in the processing and the nature of the personal data to be protected. The measures are also designed to prevent the unnecessary processing of personal data.
